REKONSTRUKSI TEORI NASIKH MANSUKH MAHMUD TAHA: Studi Kritis Kitab Al-Risalah Al-Tsaniyah Min Al-Islam

Abstract

This research aims to critically explain the theoretical construction of nasikh mansukh Mahmud Taha. The method used is a qualitative research method with a content analysis approach, so that this study not only describes Mahmud Taha's concept of nasikh mansukh but also critically analyzes the truth of the concept offered by Mahmud Taha. Based on research conducted, it was found that Mahmud Taha's concept of nasikh and mansukh was different from the understanding of ulama in general. This difference begins with his understanding of the concepts of makkiyah and madaniyyah, where according to Taha the first is the main verse (ushul) while the second is the branch verse (furu'). So according to him, the madaniyyah verse, which is a branch of law and is only applied temporarily, must be combined with the makkiyyah verse, which is the main thing and contains fundamental values such as justice, equality, tolerance, democracy, gender and in accordance with human rights values. so the law must be re-applied in the current era. However, the nasakh concept developed by Taha still has a number of epistemological problems and is therefore not valid for use in interpreting the Qur'an.
